Here's an excellent example of what happens when you leave regulation up to the GLORIOUS INVISIBLE HAND OF THE MARKET! ALL HAIL UNRESTRICTED CAPITALISM!
Because companies will, on their own, act in the best interests of society and the consumer, right? No need for adequate safeguards and protections. That's just downright evil nannystatism!
A triumph of capitalist pharmaceuticals, I say!

When profit comes into conflict with consumer interests...lie lie lie to continue making money and take advantage of poor government oversight by privatization fads!

Hey Tech: Your anger is misplaced. This company was caught. Unrestricted capitalism does not mean lying about the benefit of a drug. SO, this company is toast.
The ability to compete does not give any company the right to run a scam. Criminal law is already in place to take care of that.

I think if we had stronger, stricter regulations on what can and can't be said, better oversight, things like this would be harder to do in the first place and more easily caught. That such a scam could go on for so long is a testament to the problems rife in our system. The problem is that many people, including Libertarians, want to dismantle the state intervention system and make the government as pathetic as possible because "smaller government is better."
There would be no FDA at all probably if Libertarians had their way.
